The jury began about 4:35 p.m. Tuesday to deliberate on punishment after a one-witness second phase of the trial in the case in which the defendant and victim were 17 at the time of the killing.<\/p>\n<p>Judge John Roach had directed the jury to consider a sentence of between five and 99 years, or life, or, if it found that Anthony was under the influence of sudden passion, two to 20 years. Anthony, who is 19, must serve half of the term, 17 1\/2 years, before he becomes eligible for parole.<\/p>\n<p>After the sentencing verdict, Metcalf\u2019s aunt, parents and twin brother read <a href=\"https:\/\/www.wfaa.com\/article\/news\/local\/frisco-murder-trial\/karmelo-anthony-track-meet-stabbing-trial-closing-arguments-case-live-updates-austin-metcalf\/287-22409f8e-1f6b-4f86-a310-0d820449a672\" rel=\"Follow\" target=\"_blank\">victim impact statements<\/a>.<\/p>\n<p>\u201cI will forever miss the remarkable young man Austin was,\u201d his aunt said, according to KXAS-TV.<\/p>\n<p>\u201cThere is a void that can never be filled,\u201d she said. \u201cOur faith has sustained us. That faith does not lessen the pain of losing him.\u201d<\/p>\n<p>Austin\u2019s mother, Meghan Metcalf, next spoke to Anthony, who slightly raised his head from where he had rested it on a table, WFAA-TV reported.<\/p>\n<p>\u201cWe will never know what our future could have been,\u201d the mother said, crying. \u201cFor journalists, activists, this is a story. For our family, this is our reality.\u201d<\/p>\n<p>\u201cMy house is now quiet,\u201d Meghan Metcalf said, and all her conversations with her son are at his grave. \u201cHe didn\u2019t just die. He was taken from us.\u201d<\/p>\n<p>Addressing the defendant angrily, the mother said, \u201cYou should feel lucky you got 35 years because I\u2019ve been given a life sentence without my son.\u201d<\/p>\n<p>Austin\u2019s father, Jeff Metcalf, also expressed his anger to the defendant, saying \u201cWe were robbed!\u201d and telling Anthony, \u201cDon\u2019t look down!\u201d<\/p>\n<p>Testimony and evidence in the trial has not focused on race, but social media posts and protests outside the courthouse have divided along racial lines in a case where the victim was white and the defendant is Black.<\/p>\n<p>\u201cThis was never about race,\u201d Jeff Metcalf said, according to WFAA. \u201cIt is about right and wrong.\u201d<\/p>\n<p>\u201cMy boys weren\u2019t bullies,\u201d the father said, adding that he has been harassed by activists. \u201cI\u2019ve been swatted six times.\u201d<\/p>\n<p>\u201cMy son\u2019s death destroyed the person I used to be,\u201d the father said. \u201c&#8230; People think grief is sadness \u2014 it is not. It is rage. Pure unfiltered rage.\u201d<\/p>\n<p>Austin\u2019s twin, Hunter Metcalf, spoke last and told Anthony, \u201cYou took everything from me.\u201d<\/p>\n<p>\u201cYou took a son, a brother, a friend, and my best friend from this world,\u201d Hunter said. \u201cYou took someone from me who was supposed to be an uncle, godfather to my kids. Now I want everything taken from you.\u201d<\/p>\n<p>After court adjourned, Collin County District Attorney Greg Willis made a statement as he stood alongside the Metcalf family.<\/p>\n<p>\u201cToday, justice was served,\u201d Willis said. \u201cA year ago, when this senseless murder unfolded, I said it had struck a deep nerve in Collin County and far beyond. I asked our community to ignore all the noise, and instead be level-headed and patient as the processed worked. Today, the process delivered accountability.\u201d<\/p>\n<p>\u201cWe are grateful to this jury, and we are grateful that the good citizens of Colin County had an opportunity to weigh in on this case,\u201d he said. \u201cI\u2019m proud of the exceptional work of Bill Wirskye, and our team of prosecutors, DA investigators and victim advocates, and all the good and outstanding men and women of the Collin County District Attorney\u2019s office.\u201d<\/p>\n<p>Willis also thanked the \u201cbrave kids\u201d who testified in the case and thanked the Metcalf family.<\/p>\n<p>\u201cTheir strength and grace throughout this unimaginable journey has been inspiring,\u201d he said. \u201cThey won\u2019t be taking questions at this time, but their presence speaks volumes about their commitment to seeking justice for Austin.\u201d<\/p>\n<p>In the state\u2019s punishment closing argument, Assistant District Attorney Dewey Mitchell <a href=\"https:\/\/www.wfaa.com\/article\/news\/local\/frisco-murder-trial\/karmelo-anthony-track-meet-stabbing-trial-closing-arguments-case-live-updates-austin-metcalf\/287-22409f8e-1f6b-4f86-a310-0d820449a672\" rel=\"Follow\" target=\"_blank\">told the jury,<\/a> \u201cYou are about to hear a lot about the age of this defendant,\u201d according to WFAA-TV. \u201cAbsolutely, talk about his age. I\u2019m also going to ask you to consider the age of Austin Metcalf.\u201d<\/p>\n<p>Mitchell showed the jury an April 2, 2025, photo taken at Kuykendall Stadium in Frisco in which coaches are gathered around Metcalf, performing chest compressions, while at least four people prayed nearby.<\/p>\n<p>First Assistant District Attorney Bill Wirskye argued that sudden passion does not apply in the Anthony case. It requires a finding that the stabbing was \u201cdirectly caused by and arising out of provocation by the individual killed,\u201d Wirskye said.<\/p>\n<p>While Wirskye did not ask the jury to assess a precise number of years, he argued that it should \u201chand out a sentence that is meaningful.\u201d<\/p>\n<p>Read more <a href=\"https:\/\/durhammovinghub.com\/?p=2112\">Judge hears arguments on sealing pretrial motions in the Faith Hedgepeth murder case<\/a><\/p>\n<p>\u201cEveryone in the nation will know how you reacted to senseless loss and murder,\u201d he told the jury, according to WFAA.<\/p>\n<p>\u201cMercy to the guilty is cruelty to the innocent,\u201d Wirskye said.<\/p>\n<p>In his closing argument, defense attorney Mike Howard said, \u201cAnyone who stands up here and tells you &#8230; a number clearly doesn\u2019t understand how hard your job is. I can only ask you to consider both sides, follow your heart, and follow the law.\u201d<\/p>\n<p>Speaking on sudden passion, Howard said that it is a finding that emotion caused by provocation led to an act made in the heat of the moment, KXAS-TV reported. \u201cSudden passion doesn\u2019t mean blaming Austin or Hunter or any of those Memorial kids under that tent,\u201d he said. \u201cThis is not about blaming a victim.\u201d<\/p>\n<p>Surveillance video shows that the <a href=\"https:\/\/www.star-telegram.com\/news\/local\/article316027240.html\" rel=\"Follow\" target=\"_blank\">altercation between the two students<\/a> happened in \u201cmere seconds,\u201d Howard said. If the jury believes that \u201cKarmelo felt terror in that moment such that it rendered his mind incapable that he didn\u2019t have time for cool reflection, then sudden passion applies,\u201d he said.<\/p>\n<p>\u201cI ask you to consider both sides,\u201d Howard said. \u201cYes, the Metcalfs have been irrevocably changed by this, and all of our hearts go out to them. The Anthonys, too. There are innocent people on both sides who have lost significantly.\u201d<\/p>\n<p>The jury deliberated for about three hours before it reached its guilty verdict shortly before 2 p.m.<\/p>\n<p>A crowd of supporters on both sides grew outside the Collin County Courthouse in McKinney to await the verdicts. Some in the crowd shouted at each other as deputies surrounded them to calm the tension.<\/p>\n<p>A punishment phase can include evidence of other crimes or bad acts and witness testimony on character and the effect on the families.<\/p>\n<p>The prosecution called no witnesses in the punishment phase. The defense called <a href=\"https:\/\/www.nbcdfw.com\/news\/local\/closing-arguments-expected-tuesday-in-karmelo-anthonys-murder-trial\/4033724\/\" rel=\"Follow\" target=\"_blank\">Anthony\u2019s mother, Kala Hayes<\/a>, as its only witness and asked few questions, KXAS-TV reported.<\/p>\n<p>\u201cHe\u2019s my oldest,\u201d said Hayes, who began crying, according to KXAS. \u201cHe\u2019ll always be my baby. I love him very much.\u201d<\/p>\n<p>Karmelo also appeared to be crying as his mother spoke, KXAS reported.<\/p>\n<p>\u201cDo you believe Melo regrets what he did?\u201d defense attorney Howard asked.<\/p>\n<p>\u201cYes, I know my son, and he\u2019s very sorry for what he did,\u201d Hayes said.<\/p>\n<p>\u201cIs there anything you want to tell the jury?\u201d Howard asked.<\/p>\n<p>\u201cPlease have mercy on my son,\u201d Hayes said.<\/p>\n<p>On cross examination, prosecutor Wirskye asked Hayes if Anthony \u201cstill gets to be a part of your life,\u201d and she said yes, WFAA reported.<\/p>\n<p dir=\"ltr\" lang=\"en\">KRLD 1080 is live from the Karmelo Anthony trial in McKinney at the Collin County Courthouse &#8212; stay tuned for updates<\/p>\n<p>\ud83c\udfa5: Emily Capetillo <a href=\"https:\/\/t.co\/zgwwotF0mp\">pic.twitter.com\/zgwwotF0mp<\/a><\/p>\n<p>In closing arguments in trial\u2019s guilt-innocence phase on Tuesday morning, Howard said that Metcalf did not have <a href=\"https:\/\/www.dallasnews.com\/news\/courts\/article\/karmelo-anthony-trial-updates-closing-arguments-22296290.php\" rel=\"Follow\" target=\"_blank\">the legal authority<\/a> to \u201cput his hands on\u201d Anthony, according to The Dallas Morning News.<\/p>\n<p>\u201cA hit, a shove, a push,\u201d Howard told the jury, \u201c\u2019Melo had an absolute right to defend himself from that.\u201d<\/p>\n<p>Anger flared in the altercation between the two students under a Memorial High School tent at the track meet, witnesses said.<\/p>\n<p>Metcalf was a Memorial High School student. Anthony was a student at Centennial High School.<\/p>\n<p>Prosecutors argued Anthony could have left the tent when he was confronted by Metcalf, Howard said.<\/p>\n<p>\u201cI am sure he wishes he did,\u201d the defense attorney said, according to WFAA.<\/p>\n<p>The Collin County Criminal District Attorney\u2019s Office described Metcalf\u2019s killing in Frisco as an unjustified, provoked murder.<\/p>\n<p>Anthony \u201chad a secret \u2014<a href=\"https:\/\/www.star-telegram.com\/news\/local\/crime\/article316005062.html\" rel=\"Follow\" target=\"_blank\"> he had a knife<\/a> that day,\u201d Wirskye said in the state\u2019s closing argument. \u201cHe was always gonna come out on top that day. That is a mindset.\u201d<\/p>\n<p>\u201cYou don\u2019t get to meet a shove with a stab \u2014 especially if you provoke a shove,\u201d Wirskye told the jury.<\/p>\n<p>Judge Roach included a legal advisory on self-defense justification in the jury\u2019s instructions. The judge, who presided at the trial in the 296th District Court in Collin County, denied a defense request for the jury to be permitted to consider criminally negligent homicide, but jurors were instructed to consider manslaughter, a reckless killing.<\/p>\n<p>The defense argued that Anthony sought shelter from rain under the Memorial tent because his school did not have a tent. The defense attorney said Anthony was sitting down and talking to someone he knew when Austin Metcalf and Metcalf\u2019s twin brother confronted him.<\/p>\n<p>Witnesses told police that the two 17-year-old students fought after Metcalf asked Anthony to move from under the Memorial High School tent at Kuykendall Stadium, and that Metcalf either pushed or grabbed Anthony before Anthony pulled a knife from his bag and stabbed Metcalf in the chest.<\/p>\n<p>Anthony cried and told officers that he acted in self-defense and that Metcalf had \u201c<a href=\"https:\/\/www.star-telegram.com\/news\/local\/crime\/article303454751.html\" rel=\"Follow\" target=\"_blank\">put his hands on me<\/a>.
