{"id":5124,"date":"2026-07-21T19:04:19","date_gmt":"2026-07-21T19:04:19","guid":{"rendered":"https:\/\/durhammovinghub.com\/?p=5124"},"modified":"2026-07-21T19:04:19","modified_gmt":"2026-07-21T19:04:19","slug":"nc-attorney-general-says-duke-energys-lowered-rate-increase-is-still-too-high","status":"publish","type":"post","link":"https:\/\/durhammovinghub.com\/?p=5124","title":{"rendered":"NC attorney general says Duke Energy\u2019s lowered rate increase is still too high"},"content":{"rendered":"<p>North Carolina Attorney General <a href=\"https:\/\/ncdoj.gov\/\" rel=\"Follow\" target=\"_blank\">Jeff Jackson is refusing<\/a> to join Duke Energy Carolinas\u2019 <a href=\"https:\/\/www.charlotteobserver.com\/news\/state\/north-carolina\/article316579599.html\" rel=\"Follow\" target=\"_blank\">proposed rate settlement<\/a>, arguing the utility should further reduce a residential increase that has already been cut nearly in half from its original request.<\/p>\n<p>Read more <a href=\"https:\/\/durhammovinghub.com\/?p=5122\">North Carolina cyclosporiasis case update: 250+ new infections<\/a><\/p>\n<p>Jackson announced Tuesday that his office would continue challenging Duke\u2019s request before the North Carolina Utilities Commission rather than sign onto <a href=\"https:\/\/news.duke-energy.com\/releases\/duke-energy-carolinas-reaches-agreement-with-north-carolina-public-staff-and-other-stakeholders-to-deliver-a-lower-cost-path-to-power-north-carolinas-future?_gl=1*1gy1rha*_gcl_au*MTIyODc2MDY4MS4xNzc3OTE4ODc1*_ga*NTE5MDk2NDA0LjE3NzY0MzMwMTI.*_ga_HB58MJRNTY*czE3ODQ1NTkzMDAkbzE1JGcxJHQxNzg0NTU5MzA4JGo1MiRsMCRoMA..\" rel=\"Follow\" target=\"_blank\">the agreement reached<\/a> between the utility, the North Carolina Public Staff and several other parties. While he praised parts of the proposed settlement, including new discussions over data center costs and a lower profit rate for Duke, Jackson said the proposed 9.5% residential increase over two years remains too high.<\/p>\n<p>\u201cDuke started this case asking families for an 18% increase,\u201d Jackson said in a statement. \u201cWe pushed back, and now its own filing shows 9.5%. That is movement in the right direction, but it is still too high. We are not joining this deal, and we will keep pushing for lower rates.\u201d<\/p>\n<p>Duke originally sought an approximately 18% residential increase when it filed the case last November, prompting criticism that North Carolinians could not absorb another jump in utility bills. Jackson has been among the utility\u2019s most vocal critics throughout the case. Earlier this year, he urged regulators to reject Duke\u2019s proposed return on equity, the profit rate the company is allowed to earn, arguing the request would unnecessarily increase customers\u2019 bills.<\/p>\n<p>Last week, Duke and the Public Staff, the state agency charged with representing utility customers, announced a comprehensive settlement that would <a href=\"https:\/\/www.charlotteobserver.com\/news\/local\/article316463546.html\" rel=\"Follow\" target=\"_blank\">reduce the proposed residential increase<\/a> to 9.5% over two years if approved by regulators. The agreement also lowered Duke\u2019s proposed return on equity from its original request of 10.95% to 9.8%.<\/p>\n<p>Jackson said those changes do not go far enough.<\/p>\n<p>His office\u2019s expert testimony supported a 7.4% return on equity, which Jackson said would save Duke customers an estimated $1.37 billion over the next two years. The proposed settlement\u2019s 9.8% return remains well above that recommendation, according to the attorney general.<\/p>\n<p>Jackson also disputed Duke\u2019s characterization of the agreement as an average annual increase of 3.7% over two years, since that is the averaged proposed rate among all customers, not just residential. Duke has said the settlement would raise residential rates 5.9% in the first year and 3.6% in the second year, for a cumulative increase of 9.5%.<\/p>\n<p>Read more <a href=\"https:\/\/durhammovinghub.com\/?p=5120\">West Nile virus has been identified in Mecklenburg mosquitoes<\/a><\/p>\n<p>Beyond rates, Jackson said the settlement makes progress toward one of his office\u2019s biggest concerns: ensuring data centers costs are not shifted onto residential customers. Under the agreement, Duke would participate in a separate process to create rules for who pays infrastructure costs for large energy users such as data centers.<\/p>\n<p>Jackson called that development encouraging but said key questions remain unresolved.<\/p>\n<p>The NCUC will ultimately decide whether to approve the settlement after reviewing testimony from all parties.
